(Sò Ann) To all Authorities Concerned - Jan. 29, 2005

Messrs.

It is not with a cheerfulness of the heart that, from my prison cell in Pétion Ville where I have been languishing since nearly nine (9) months, I address all the authorities concerned – Haitian and/or Occupying forces - able to inform me about my current detention.

Let us say immediately that, me not having been condemned of any crime, this open letter does not have as a secondary objective to beseech any form of clemency. Neither does my self-esteem allow me to withstand any form of pity or commiseration.

For the sake of History, Messrs., and, before the fragile sexagenarian of fragile health that I am deteriorates into a state of madness, or is victim of any disability; or before my "file" as a prisoner, having been submitted, becomes covered with a layer dust too thick, I must emphasize to you certain facts for whatever purpose they may serve:

1) On May 10, 2004, in the middle of the night, obviously without any arrest warrant, I was yanked from my bed and was humiliated by the Occupying forces.

2) On May 12, 2004, appearing in front of the examining magistrate, Maître Brédi Fabien, the latter recognized my innocence and decided on my immediate release.

3) The decision made by the examining magistrate in my case was not respected: instead of allowing me to return home, "civil servants" in a situation of authority, giving themselves the capacity to make certain decisions more effective than the legal judicial authority of final recourse, led me, without any explanation, to the Penitentiary of Pétion Ville where I still remain.

4) In addition, I learned, by radio, that certain citizens, arrested like me for political reasons, were brought before their natural judge. However, contrary to my case, their innocence having been recognized, these citizens were released, purely and simply, according to the normal mechanism of any healthy justice, to return peacefully to their homes.

Am I to understand, Messrs., that my being a woman is responsible for this arbitrary, iniquitous, absurd and abusive treatment that you make me undergo?

In the absence of a clear and sufficient explanation on your part, I can trust only my imagination, to conclude that Your behavior regarding my case is in direct connection with my social and political conception, which prohibits me from validating all forms of occupation, exploitation, injustice or neocolonialism.

If however my interpretation is correct, Messrs., know that at my age, I can neither become an opportunist, nor change, distort or reject the guiding principles for which I have always struggled for, namely:

v An effective social justice for those which, formerly, were slaves of the white man.

v An effective participation of all the Haitian citizens, whatever their origin, in the affairs of their country.

v A progressive and profound improvement of the condition of the working masses.

v The same respect and the same justice for all.

v An effective protection and a sufficient assistance for all those who are in need.

Then Messrs., to reach this end, I have always sought assistance among honest, clean, rightly-standing, just, thoughtful, and competent citizens; and refused all forms of complicity with corrupt collaborators or sell-outs of the Fatherland.

Moreover, it is to safeguard my freedom of thought and action, and also, to respect my guiding principles, that I have never accepted any "position" in any government.

It is necessary to add that the illegal imprisonment; the odious, debasing and scornful blackmails; and the strong pressures exerted against my person will never prevent me, as long as I am alive and well, from continuing, without slackening, to work for the largest good for the greatest number, in order for the disenfranchised, the dispossessed, and the forgotten to pass from the state of misery to that of poverty, whatever the government in place.

All things considered, is this really a crime, for a citizen, to want to work without respite, for the safeguard of the dignity of the good Haitian people?

In conclusion, Messrs., since right now, you can better identify the citizen, Annette Auguste, the latter, from her prison cell in Pétion Ville, expects of you a professional and responsible behavior, respectful of the laws and of justice, before your easily-retractable error becomes a disastrous horror.

LETTRE OUVERTE DE LA PRISONNIERE ANNETTE AUGUSTE (SO AN) A TOUTES LES AUTORITES CONCERNEES

Messieurs,

Ce n’est pas de gaieté de cœur que, de ma cellule de prisonnière à Pétion Ville où je croupisse depuis près de neuf (9) mois, je m’adresse à toutes les autorités concernées – haïtiennes et/ou Forces d’occupation – susceptibles de m’éclairer sur ma détention actuelle.

Disons tout de suite que n’étant pas une condamnée, cette lettre ouverte n’a pas pour objectif secondaire d’implorer une forme quelconque de clémence. De plus, mon amour propre ne me permet pas non plus de supporter aucune forme de pitié ou de commisération.

Pour l’Histoire, messieurs, et, avant que la sexagénaire de santé fragile que je suis sombre dans la folie, ou soit victime d’un handicap quelconque; ou encore avant que mon « dossier » de prisonnière en dépôt se couvre d’une couche de poussière trop épaisse, je tiens à vous souligner certains faits à toutes fins utiles :

1) Le 10 mai 2004, en pleine nuit, évidemment sans mandat aucun, j’ai été arrachée de mon lit et humiliée par les Forces d’occupation.

2) Le 12 mai 2004, comparue par devant le juge d’instruction, Maître Brédi Fabien, ce dernier a reconnu mon innocence et a décidé de mon élargissement immédiat.

3) La décision du juge d’instruction prise à mon adresse n’a pas été respectée: au lieu de me laisser rentrer chez moi, des « fonctionnaires » en situation d’autorité, se donnant le pouvoir de prendre certaines décisions plus efficaces que l’autorité de la chose jugée, m’ont conduite, sans explication aucune, au Pénitencier de Pétion Ville où j’y suis encore.

4) Par ailleurs, j’ai appris, par radio, que certains citoyens, arrêtés comme moi pour des raisons politiques, ont été traduits par devant leur juge naturel. Cependant, contrairement à mon cas, leur innocence une fois reconnue, ces citoyens ont été relâchés, purement et simplement, selon le mécanisme normal de toute justice saine, pour rentrer paisiblement chez eux.

Dois-je comprendre, messieurs, que ma qualité de femme est responsable de ce traitement arbitraire, inique, absurde et abusif que vous me faites subir ?

A défaut d’explication claire et suffisante de votre part, je ne peux me fier qu’à mon imagination, pour conclure que Votre comportement à mon égard est en rapport direct avec ma conception sociale et politique qui m’interdit de valider toutes formes d’occupation, d’exploitation, d’injustice ou de néo-colonialisme.

Si toutefois mon interprétation est correcte, messieurs, sachez qu’à mon age, je ne peux ni devenir opportuniste, ni changer, fausser ou repousser les principes de base pour lesquels j’ai toujours lutté à savoir :v Une justice sociale et efficace pour ceux-là qui, jadis, furent des esclaves des blancs.

* Une participation effective de tous les citoyens haïtiens, quelle que soit leur origine, aux affaires de leur pays.

* Une amélioration progressive et profonde de la condition des masses laborieuses.

* Un même respect et une même justice pour tous.

* Une protection efficace et une aide suffisante pour tous ceux qui sont dans le besoin.

Alors messieurs, pour arriver à cette fin, j’ai toujours cherché de l’aide chez les citoyens honnêtes, intègres, propres, verticaux, justes, réfléchis et compétents ; et refuser toutes formes de complicité avec des vendeurs de Patrie, des collabos ou des corrompus.

D’ailleurs, c’est pour sauvegarder ma liberté de penser de d’agir et aussi, pour respecter mes principes de base, que je n’ai jamais accepté aucun « poste » sous aucun gouvernement.

Est-il besoin d’ajouter que la prison illégale, les chantages odieux, vils et méprisables, les fortes pressions exercées contre ma personne ne m’empêcheront jamais, tant que je serai vivante et valide, de continuer, sans relâche, à travailler pour le plus grand bien du plus grand nombre, afin de faire passer les déshérités et les oubliés de l’état de misère à celui de pauvreté, quel que soit le gouvernement en place.

En somme, est-ce vraiment un crime, pour une citoyenne, de vouloir travailler sans répit, à la sauvegarde de la dignité du bon peuple haïtien ?

En conclusion, messieurs, puisque à présent, vous pouvez mieux identifier la citoyenne, Annette Auguste, cette dernière, de sa cellule de prison à Pétion Ville, attend de vous un comportement professionnel, responsable, respectueux des lois et de la justice, avant que votre erreur facilement rétractable ne se transforme en horreur funeste.
